Terms of Service

These terms govern your use of Modernist.Recipes (the “Service”). By creating an account or subscribing, you agree to them. If you do not agree, please don’t use the Service.
1. Who we are
Modernist.Recipes is a service operated by Bookhouse Digital Publishing Services Pty Ltd (ACN 076 454 754), trading as Modernist Recipes, based in Australia. You can reach us through our contact page.
2. The Service
Modernist.Recipes is a platform for capturing, storing, scaling, and presenting personal recipes, with optional AI-assisted import and image tools. We offer a free tier and paid membership tiers. What each tier includes, and its price, is shown on our pricing page and forms part of these terms.
We may change, add, or remove features over time. We’ll avoid removing something you’re actively paying for without reasonable notice.
3. Your account
You’re responsible for your account and for keeping your login details secure. Enable Two-Factor Authentication (2FA) if you are able to use it. You must give accurate information and be old enough to enter a contract in your jurisdiction. Tell us through our contact page if you think your account has been used without your permission.
4. Acceptable use
Use the Service for your own lawful recipe-keeping. Don’t:
- break the law, or use the Service to infringe someone else’s rights;
- upload content you don’t have the right to upload;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
- resell or redistribute the Service without our written agreement.
Fair use on Max tiers. Where a tier shows “Max”, there is no fixed limit: you may create and store as much as your own cooking genuinely calls for. To keep the Service fast and fair for everyone, we may enforce limits on an account whose usage is distinctly exceeding other users of the Service, and we'll get in touch before doing so wherever practical.
We may suspend or close accounts that breach these terms.
5. Your content
Your recipes, photos, and notes are yours. You keep all rights in them. You grant us a limited licence to store, process, and display that content back to you (and to anyone you deliberately share it with) solely to operate the Service. This licence ends when you delete the content or close your account, except for backups that age out on our normal cycle.
You’re responsible for the content you upload, including having the right to use any recipe text or images you bring in.
6. AI features
Some features use third-party AI services to convert imported recipes, read recipe photos, and generate spice-blend images. When you use these features, the relevant content (for example the text or photo you’re importing, or the blend you’re picturing) is sent to those providers to produce the result. AI output can be wrong or incomplete – always check it before you rely on it. Our privacy notice lists the AI providers involved.
AI features on paid tiers run on a weekly allowance of AI items, with the option to buy additional credit packs. Credits are usable only while you’re subscribed. If your membership lapses, unused purchased credits aren’t lost: they stay dormant on your account and become available again if you resubscribe. They can’t be used while you’re unsubscribed, and they’re personal to your account and can’t be transferred. Details are on the pricing page.
7. Subscriptions, billing, and payments
Paid memberships are sold as recurring subscriptions, billed monthly or yearly in advance in euros, and renew automatically at the end of each period until you cancel.
Payments are processed by Paddle, our merchant of record. Paddle handles the checkout, payment, and any applicable taxes, and your purchase is also subject to Paddle’s Buyer Terms. Your card statement and receipts will reference Paddle. We don’t receive or store your card details.
Prices may change; we’ll give reasonable notice of any change to a price you’re paying, and it will only take effect from your next renewal.
8. Cancelling, and what happens to your content
You can cancel anytime from your account settings. Cancellation stops future billing. Your paid access continues until the end of the current paid period, after which your account reverts to the free Member tier.
The Home and Pro tiers let you keep more recipes and images than the free tier. When you cancel or let a membership lapse and drop to a lower tier, that tier’s allowances apply: recipes saved beyond the tier’s recipe limit, and photos saved beyond each recipe’s photo limit, are no longer shown.
We choose what stays visible for you, in a fixed order, up to the new tier’s allowance. Your favourited recipes come first, in the order you favourited them; if there’s room left under the allowance, your other recipes follow in the order you added them, oldest first. This keeps the content you’ve marked as important, and the recipes you’ve had longest, visible. On each visible recipe, the photos shown are the first in your arranged order up to that tier’s per-recipe limit, with the main photo always kept. Step-by-step photos are shown on the Pro tier.
Nothing is deleted. The content that drops out of view is kept and simply hidden while you’re on the lower tier, and it becomes visible again if you upgrade. This means adding a large library on a paid tier and then downgrading to free does not keep that whole library accessible on the free tier.

9. Availability
We aim to keep the Service running well but don’t guarantee it will be uninterrupted or error-free. We may carry out maintenance, and occasionally features may be unavailable.
10. Disclaimers and liability
The Service is provided “as is.” To the extent permitted by law, we exclude implied warranties. Nothing in these terms limits rights you have under the Australian Consumer Law or other laws that can’t be excluded.
To the extent permitted by law, our total liability to you for any claim connected with the Service is limited to the amount you paid us in the twelve months before the claim. We’re not liable for indirect or consequential loss.
11. Changes to these terms
We may update these terms. If a change is material, we’ll give reasonable notice (for example by email or an in-app notice). Continuing to use the Service after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of its courts. This does not remove any mandatory consumer protection you have where you live.
